Third Wave settles patent suit with Digene

Madison, Wis. — Third Wave Technologies has settled a patent lawsuit with Digene Corporation without any grants of licenses or money changing hands, according to a press release.

The dispute concerned human papilloma virus (HPV) treatments. Last October Third Wave filed suits against several companies, including Digene as well as Chiron and Bayer, who make hepatitis C virus (HCV) treatments. Third Wave was seeking court support for its right to sell its products, and to "clear any remaining ambiguities about the company's freedom to operate in valuable markets like those for HCV and HPV," CEO John Puisis said at the time.

Third Wave and Digene have agreed not to sue each other for a year.

Digene, located in Gaithersburg, Maryland, and Third Wave, in Madison, both make DNA and RNA tests for a variety of diseases.
